PTI reports that a court in Nagpur has acquitted four accused Maoists, arrested two years ago, for lack of evidence.
"The court took into account contradictory evidence produced by police against them. In one such instance, police disclosed that a pistol had been seized from Ferreira at the time of his arrest but during the trial a firearm of different make was produced."
By similar standards of evidence, Binayak's case would have been dismissed long ago. And Binayak is not even a Maoist...but the charade of his trial justice must takes its own course.
This is Binayak's wife Ilina reporting on the last session in November.
...the hearings in the trial took place from the 23rd to the 26th. The main witnesses this time were
(a) relating to the telephone held by Narayan Sanyal's sister in law to which Binayak called each time after his visit to NS. Acc to the presecution this is a very significant fact as classified info is supposed to have travelled out from NS through this route. In fact, phone calls related to news of his welfare, but we can only say this later.
(b) Inspector Jagrit, who arrested Pijush Guha and searched our house. He was part of the investigation team, but is not the I[investigating] O[fficer] responsible for coordinating the investigation. Jagrit made a big noise about not finding a stethoscope, medicines and injection syringes at the house. Obviously, the burden is now on us to introduce defence witnesses re Binayak's medical work. The Director of the Forensic lab who examined the computer did not turn up for the umpteenth time. There is a new judge, and I was actually in court after a long time, so got an opportunity to get a feel of things. The new judge (Ganpat Rao) seems more experienced than the previous one, and he rejected the forged document that the prosecution had tried to introduce and took it out of the evidence. We had earlir objected to this, and the old judge had kept a decision on the objection pending. Today he asked Jagrit how this doc[ument] unsigned by Binayak got in, and when Jagrit replied that he himself had no idea, he promptly ordered that this doc be removed from the evidence. All this is very tedious, and on all four days, the hearings have gone on for long hours,
Bail Petition of Dr. B. Sen granted today by the Supreme Court of India.
Most of the communities in India (such as Bengali), are succumbed in 'Culture of Poverty'(a theory introduced by an American anthropologist Oscar Lewis), irrespective of class or economic strata, lives in pavement or apartment. Nobody is at all ashamed of the deep-rooted corruption, decaying general quality of life, worst Politico-administrative system, weak mother language, continuous absorption of common space (mental as well as physical, both). We are becoming fathers & mothers only by self-procreation, mindlessly & blindfold. Simply depriving their(the children) fundamental rights of a decent, caring society, fearless & dignified living. Do not ever look for any other positive alternative behaviour (values) to perform human way of parenthood, i.e. deliberately co-parenting of those children those are born out of ignorance, real poverty. All of us are being driven only by the very animal instinct. If the Bengali people ever be able to bring that genuine freedom (from vicious cycle of 'poverty') in their own life/attitude, involve themselves in 'Production of Space’(Henri Lefebvre), at least initiate a movement by heart, decent & dedicated Politics will definitely come up.
